Terms of Service
1. Agreement to these terms
CallMyAI is a voice-AI platform for creators. A creator builds an AI persona modelled on that creator's own voice, and fans pay per minute to call and have a live voice conversation with that persona. Creators are independent and choose their own persona's style and subject matter. The platform may contain mature, sexually explicit content and is intended only for adults.
By creating an account, buying minutes, placing or receiving a call, or otherwise using the platform, you agree to these Terms of Service. If you do not agree, do not use the platform.
These terms apply to everyone. Section 9 adds terms for fans; Section 10 adds terms for creators. Where a section is labelled for one or the other, it applies in addition to the general terms, not instead of them.
Also part of your agreement with us: the Acceptable Use Policy, the Privacy Policy, the Community Guidelines, the Age Verification & Records Statement, and — for creators — the Creator Agreement. Creators established in the EU or UK are additionally covered by our Platform-to-Business terms.
2. Age requirement
The platform may contain adult, sexually explicit material and is intended solely for consenting adults.
You represent that you are at least 18 years old, or the age of majority where you live if that is higher, and that you have the legal right to access adult content in your location. We may verify age and identity at any time, and may refuse, suspend, or end access if we cannot confirm you meet this requirement. Access from any location where this service or adult content is unlawful is prohibited.
3. Where the service is available
Creators and fans are separate gates, and the lists differ.
Creators may join from the United States, Canada, the United Kingdom, Ireland, Germany, France, Spain, Italy, the Netherlands, Australia, New Zealand, Mexico, Brazil, Colombia, Argentina, Chile, and Peru.

Inbound phone calling is available only in the United States and Canada. Fans elsewhere connect to a persona through a web browser. We may add or remove supported countries as our compliance coverage changes.
4. Accounts and security
Provide accurate information and keep your login credentials secure. You are responsible for activity under your account. Tell us promptly at support@callmyai.ai about any unauthorised use. We may suspend or close accounts that breach these terms.
5. What the service is — and the AI disclosure
You are talking to an AI, not a live person. Each voice persona is an artificial-intelligence system modelled on a real creator who has consented to it. The persona uses a voice that sounds like that creator's and is designed to converse in that creator's style, but the creator is not on the call, and the AI does not represent real, live statements or commitments by the creator or anyone else.
If you sincerely ask whether you are speaking to an AI, the persona will tell you. It will not claim to be a real, named third party or a real celebrity.
All conversations are adult fantasy and entertainment. Nothing an AI persona says is a real offer, promise, factual claim, professional advice, or real-world commitment of any kind.
6. Caller anonymization
Protecting fans is built into how the platform works. Creators never see a fan's real phone number, email, or legal identity. A fan appears to a creator only under an anonymized alias, and the same fan appears under a different alias to each different creator.
You agree not to attempt to defeat, reverse, or circumvent this anonymization, and not to attempt to identify a creator or another fan. Full detail: How caller anonymization works.
7. Acceptable use
The enumerated list of what is prohibited lives in the Acceptable Use Policy, which forms part of these terms. Read it — it is short and specific.
Our AI personas operate under a fixed set of safety rules that no creator or fan can override. The AI is designed to refuse, redirect, or end a call when a conversation crosses those lines. The prohibitions include, without limitation: content sexualising anyone under 18; real non-consensual violence; incest and bestiality; hate speech and attacks based on protected characteristics; solicitation, prostitution, or escort arrangements; facilitation of illegal activity; and attempts to break anonymization or safety controls.
We may remove content, suspend service, and report unlawful activity to authorities as required by law.
8. Recording, redistribution, and what a creator cannot control
You may not record, reproduce, resell, publish, or redistribute call audio, transcripts, or any part of a conversation, in whole or in part, without our prior written permission. This applies to fans and to anyone else.
We take this seriously, and we will act on reports and support creators in pursuing redistribution. But we want creators to have an accurate expectation rather than a comforting one: once audio leaves the platform we can prohibit and pursue, but we cannot prevent. 9. Fan terms — minutes, billing, and refunds
9.1 Buying and using minutes. Fans pay to talk to a persona on a per-minute basis at the rate shown for that creator, plus a service fee and any applicable taxes. Minutes are consumed in real time as the call runs. Time is metered in six-second increments in the background and displayed to you in whole minutes; you are never charged for time you did not use.
9.2 The price you see. The price shown for a package is the total you pay. It is the creator's base price plus a service fee, rounded up to the next whole dollar, and it is calculated and fixed before you buy. There is no separate charge added later.
9.3 Authorization. By purchasing minutes or placing a call you authorize us and our payment processor to charge your chosen payment method for the amounts shown. Charges appear on your card statement under the discreet billing descriptor CALLMYAI. The descriptor does not name the creator you called or describe what you bought.
9.4 All sales are final, and minutes expire after 12 months. Minutes are a digital service delivered and consumed immediately. Except where a refund is required by law, purchases are final and non-refundable, including unused minutes after an account is closed.
Unused minutes remain available for 12 months from the date of purchase, after which they expire and are not refundable. We will remind you before that happens — 30 days before, 7 days before, and on the day — so an expiry never arrives without notice.
If you think you were charged in error, contact billing@callmyai.ai before disputing the charge and we will investigate in good faith.
9.5 Your credits are preserved if a call fails. If a call drops because of a problem on our side, your unused minutes stay yours. They remain on your balance for a future call with that creator. They are not returned to your card — see 9.6.
9.6 If we cannot deliver the creator's voice, the call ends. We will never substitute a different or generic synthetic voice mid-call. The creator's own voice is the product. If we cannot deliver it, the call ends with a short message and your credits are preserved under 9.5 rather than being spent. That is the remedy: preserved time, not a card refund.
9.7 Chargebacks end your access permanently. Filing a chargeback for services actually received is a breach of these terms.
If a chargeback against your payment succeeds, you are permanently blocked from CallMyAI. The block applies across the whole platform, not only to the creator you called: future purchases and inbound calls are refused, and any remaining credits are lost. It is applied automatically by our systems, without a person reviewing it at the time, and it is not limited to chargebacks we judge fraudulent or abusive. We may also pursue amounts owed.
This is why 9.4 asks you to contact us first. A billing question we can look into costs you nothing; a chargeback ends your access whatever the reason behind it. If you believe a block was applied in error, it can be challenged under the Appeals Policy.
9.8 Your privacy. See Section 6 and the Privacy Policy. Creators never receive your real contact details.
10. Creator terms
Creators are additionally bound by the Creator Agreement, which governs the voice and likeness licence, consent withdrawal, revenue share, payouts, and tax responsibilities. In summary:
- Creators are independent parties, not employees, partners, or agents.
- Creators retain ownership of their own voice and likeness, and grant us a limited licence to build, host and operate the persona.
- Creators may add their own rules to a persona, but may never weaken the platform safety floor.
- Creators earn 70% of the base per-minute price; CallMyAI retains 30%.
- Creators consent to age and identity verification and to our retention of the resulting records — see the Age Verification & Records Statement.
11. Intellectual property
The platform, its software, models, prompts, systems, designs and related know-how are owned by CallMyAI or its licensors. You receive a limited, revocable right to use the service under these terms. You may not copy, reverse-engineer, decompile, extract, or attempt to derive the platform's underlying systems, model prompts, or operational methods. Creators retain ownership of their own voice and likeness as described in the Creator Agreement.
12. Privacy and call processing
Your use of the platform is governed by the Privacy Policy. To deliver and secure the service, calls are transcribed, processed and stored — for example to give a persona conversational memory, to enforce our safety rules, and to prevent fraud and abuse.
13. Suspension, termination, and your right to reasons
We may suspend or end your access for breach of these terms, for legal or payment-network reasons, or where continued access presents a risk to the platform or its users.
If we suspend, restrict, or terminate your account or a persona, we will tell you why. You will receive a written statement of the reason, except where giving it would itself be unlawful or would compromise an ongoing investigation. You may challenge the decision — see the Appeals Policy, which explains what is appealable and how.
Terms that by their nature should survive termination — payment obligations, intellectual property, disclaimers, limitation of liability, and dispute terms — survive it.
14. Changes to these terms
We may update these terms. Where a change materially affects your rights or obligations, we will give at least 15 days' notice before it takes effect, and you may close your account during that period rather than accept it. Changes required by law, or needed to address a security or legal risk, may take effect sooner. Material changes are posted here with a new effective date.
15. Disclaimers
The platform is provided "as is" and "as available". AI personas are automated systems and may be inaccurate, unpredictable, or interrupted. All content is adult fantasy and entertainment and is not advice of any kind. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
16. Limitation of liability
To the fullest extent permitted by law, CallMyAI and its owners, officers and staff will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability for any claim relating to the service will not exceed the greater of the amount you paid us in the three months before the claim, or US $100.
Nothing in these terms limits liability that cannot lawfully be limited. If you are a consumer, you keep the rights given to you by the mandatory law of the country where you live.
17. Indemnification
You agree to indemnify and hold harmless CallMyAI and its owners and staff from claims, damages or costs arising out of your use of the platform, your content, or your breach of these terms.
18. Governing law and disputes
These terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-law rules.
Talk to us first. Before starting any formal proceeding, notify us at legal@callmyai.ai describing the dispute and what you want, and give us 30 days to resolve it. If we ask, you agree to attempt good-faith mediation before filing.
Any dispute that cannot be resolved will be settled by binding individual arbitration seated in Wyoming under the rules of a recognised arbitration body, rather than in court. You and CallMyAI waive any right to a jury trial and agree claims may be brought only individually, not as part of any class or representative action. Nothing here prevents either party from seeking relief for intellectual-property or unauthorized-access claims in court.
Time limit. Any claim arising out of or relating to these terms or the service must be brought within one year of the date the claim arose, or within one year of when you learned or should have learned of the facts giving rise to it, whichever is earlier. After that it is waived, except where applicable law forbids shortening the period.
If you are a consumer in the EU or UK, the mandatory consumer-protection rules and forums of your country of residence continue to apply and nothing in this section removes them.
19. General
If any part of these terms is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. You may not transfer or assign your rights or obligations; we may assign ours in connection with a sale or reorganisation. These terms are the entire agreement between you and us about your use of the platform.
