Creator Agreement
This Creator Agreement is between you ("you", "the creator") and CallMyAI LLC, a Wyoming limited liability company ("CallMyAI", "we", "us"). It applies from the moment you accept it and governs your use of the platform as a creator.
It sits alongside the Terms of Service, the Acceptable Use Policy and the Community Guidelines. Where this agreement and the Terms of Service address the same subject for a creator, this agreement governs.
Creators may join from the United States, Canada, the United Kingdom, Ireland, Germany, France, Spain, Italy, the Netherlands, Australia, New Zealand, Mexico, Brazil, Colombia, Argentina, Chile, and Peru.
1. What the platform does with your voice
CallMyAI builds an AI persona from recordings you submit. The persona generates synthetic speech that sounds like you, and fans have live spoken conversations with it. You are not present on those calls and you do not perform on them. Nothing you say to a fan is said by you; the persona speaks, generated by a model, from material you provided and instructions you wrote.
You should understand this clearly before you agree to it, because it is the whole of what you are licensing.
2. Independent contractor status
You are an independent contractor. You are not an employee, partner, joint venturer, franchisee, or agent of CallMyAI, and nothing in this agreement creates any of those relationships.
You control your own persona, your own pricing within the platform's limits, your own schedule, and the way you promote yourself. You are responsible for your own equipment, your own costs, and your own tax and regulatory obligations. Neither party can bind the other or incur obligations on the other's behalf.
3. Voice and likeness — what you grant, and what you keep
3.1 Ownership of your voice and likeness
You retain all ownership of your voice, your name, your likeness, and your persona's personality. CallMyAI does not acquire ownership of any of them, at any point, under any circumstances. Nothing in this agreement transfers, assigns or sells any right in your voice or likeness to us.
3.2 What you license to us
You grant CallMyAI a limited, non-exclusive, revocable, worldwide, royalty-bearing licence to do the following, and only the following:
- Build a voice model and AI persona from the recordings and materials you submit.
- Host and store that model, the persona and the materials on our systems and those of our infrastructure providers.
- Operate the persona — that is, generate synthetic speech in your voice in live conversations with fans on the platform, in exchange for the revenue share set out in section 6.
- Improve the persona's quality and performance, including retraining or tuning the voice model from the material you submitted.
- Display and promote. Display your name, chosen persona name, profile photograph, and description on the platform. We may also use them off the platform to promote your persona and CallMyAI — for example in advertising, on social media, in app-store listings, and in press or partner materials. We will not use them to endorse any third party's product, and we will stop on request when you retire your persona.
The licence is granted solely to build, operate and promote your persona and the CallMyAI platform. It does not permit us to license your voice to any third party, to use your voice for any other product, to sell or transfer the voice model, or to create any persona other than yours.
3.3 Royalty-bearing licence
The licence is granted in exchange for the revenue share in section 6. It is not a gift and it is not perpetual.
3.4 When the licence ends
The licence ends when your persona is removed from the platform — whether you retire it, you close your account, or we terminate it.
On termination of the licence we stop operating the persona, and we delete the voice model and the source recordings from our production systems. What survives is narrow and is set out in section 9.
4. Consent — how it is captured, and how it is withdrawn
This section is the record of how CallMyAI obtains the right to clone a voice. It is written to be quoted.
4.1 How consent is captured
Before any persona is built, and before any voice model is created, you complete the following. Each step is recorded, with a timestamp, against your account.
1. Identity and age verification. You present government-issued photo identification to our identity-verification provider, which checks the document's authenticity and confirms that you are the person it describes. This establishes that you are at least 18 years of age — or the age of majority where you live, if higher. 2. A verification recording made by you. You record yourself, live, speaking prescribed words. That recording is checked for signs of synthetic or manipulated audio, and a voiceprint — a mathematical fingerprint of your voice — is derived from it and retained. 3. Explicit voice consent. You affirmatively consent to the creation and operation of an AI persona generated from your voice. The consent is specific to that purpose, it is separate from your acceptance of this agreement generally, and it records what you consented to and when. 4. Your representation of rights, as set out in section 5.
No persona activates until all four are complete. A creator cannot record, publish, take calls, or earn before the gate clears. Consent is affirmative, informed, specific to the creation of an AI replica of your voice, and evidenced by a retained record — it is never inferred from your use of the platform.
4.2 Withdrawing consent
You may withdraw your consent at any time, for any reason, without giving one.
To withdraw, tell us through the Voice & Likeness Takedown route or the support address at the end of this page. On withdrawal:
- Your persona stops taking calls.
- It is retired from the platform and no longer appears publicly.
- The voice model and the source recordings are deleted from our production systems.
- The licence in section 3 ends.
You do not need our agreement to withdraw, and we will not ask you to justify it. Earnings already accrued to you remain payable, subject to section 6.
What survives withdrawal is set out in section 9 and is limited to records we are required to keep.
5. What you promise us
You represent and warrant, on entering this agreement and on each occasion you submit material:
- You are at least 18 years old, or the age of majority where you live if that is higher, and you have provided genuine government-issued identification.
- The voice in the recordings you submit is your own.
- You own or have secured all rights in every recording, script, image and other material you submit.
- You have the right to authorise the creation and operation of an AI persona of your own voice, and doing so does not breach any contract, exclusivity arrangement, management, or agency agreement, or other obligation you owe to anyone.
- Your material does not infringe any third party's copyright, trade mark, right of publicity, privacy, or other right.
- You will comply with the Acceptable Use Policy and all laws applicable to you.
If any of these ceases to be true, tell us immediately. Continuing to operate a persona while one of them is untrue is a material breach of this agreement.
6. Money
6.1 Pricing
You set your own per-minute pricing, subject to a minimum of $1.00 per minute enforced by the platform. There is no upper limit. Fans are charged a service fee on top of your price, which is shown to them separately at checkout. The service fee is not part of your base price and does not reduce what you earn.
6.2 Your share
You earn 70% of the base per-minute price of every minute a fan spends with your persona. CallMyAI retains 30%.
Time is measured in six-second increments on the backend for accuracy, and displayed to fans in whole minutes.
6.3 Payouts
Earnings accumulate to your balance and are paid on a weekly schedule to the payout method you nominate. You may also request a payout manually rather than waiting for the weekly run.
A minimum balance of $20 applies before a payout is released. A balance below $20 is not lost — it rolls forward and is paid once your balance reaches the threshold.
Your payout account must correspond to your verified identity. We do not pay a third party on your behalf.
6.4 Holds, reserves, and reversals
- Newly earned amounts are held for 7 days before becoming available for payout. This window exists because a fan's card payment can be disputed after the call has already happened, and paying out money that is later reversed would leave you owing it back.
- Earnings may be held longer where a payment is disputed, where a chargeback is pending or has succeeded, or where an account is under investigation for a suspected breach.
- Where a fan's payment is charged back, the corresponding creator share is reversed. This applies whether or not the call happened, because the underlying payment did not complete.
- Our payment processor operates its own rolling reserve against our settlement in the normal way for an adult merchant, which may affect payout timing.
We will tell you why a hold has been applied.
6.5 Tax
You are responsible for your own tax obligations. CallMyAI does not withhold tax from your earnings, and nothing we provide is tax advice.
For creators subject to United States tax reporting, we provide a Form 1099 where your earnings reach the applicable reporting threshold, currently $600 in a calendar year. You are responsible for providing accurate tax information, and we may withhold payouts until it is provided.
We do not state any other tax position in this agreement.
7. Your persona's rules
Every persona runs under a platform safety floor — a fixed set of rules injected into every conversation. You cannot see, edit, weaken, disable, or override them, and neither can a fan.
You may add your own rules on top. You can make your persona more restrictive than the floor — subjects it will not discuss, language it will not use, boundaries it will hold. Many creators do, and we encourage it.
You can never make it less restrictive. A custom instruction that conflicts with the safety floor has no effect; the floor wins.
8. Someone else's voice in your recordings
You may only build a persona from your own voice.
If a recording you submit contains a third party's voice, you must have that person's documented consent to its use. If you do not, do not submit it.
Where we find a third-party voice in your material without documented consent, we will remove the material, and where the persona is materially built on it we will retire the persona. A person who believes their voice has been used without consent can bring a claim under Voice & Likeness Takedown, and a claim opened against your persona suspends it while it is reviewed.
9. What survives removal
When your persona is retired, your consent withdrawn, or your account closed, we delete the voice model and the recordings you submitted to build it from production. We retain the following, and only the following:
- Age and identity verification records, including the identification you presented, the verification timestamp and method. These are held for legal and payment-network reasons and are described in the Age Verification & Records Statement. They are excluded from routine deletion.
- Your verification recording — the video you recorded during onboarding. It is identity evidence rather than material your persona was built from: it is never used to build or train your voice model, and it is not among the recordings deleted above. It is retained for the same reason as the consent record, and is excluded from routine deletion.
- The voice consent record — evidence that you consented, to what, and when. Deleting the evidence of consent alongside the thing it authorised would leave us unable to demonstrate the persona was ever authorised, which protects neither of us.
- Your voiceprint, so that a later claim that someone else has cloned your voice can still be measured.
- Financial records of payments made to you, as required by tax and accounting law.
- Anything subject to a legal hold or an ongoing investigation.
Nothing in this list can be used to operate a persona, and nothing in it is licensed to any third party.
10. Redistribution outside the platform — what we can and cannot do
We prohibit fans from recording, reproducing, reselling, publishing, or redistributing call audio or transcripts, in the Acceptable Use Policy and the Terms of Service. We will act on breaches we learn of and pursue them where it is proportionate to do so.
We cannot prevent it. A person on a call can point a recording device at their own speaker, and no technical control we or anyone else operates can stop that. We do not record calls ourselves, which also means we cannot detect it happening.
You should decide whether to build a persona knowing that. We would rather say it plainly here than let you discover it later.
11. Suspension, removal, and termination
We may suspend or terminate your account or your persona for breach of this agreement, the Acceptable Use Policy or the Terms of Service; for legal or payment-network reasons; or where continued operation presents a risk to the platform or to another person.
If we suspend, restrict or terminate your account or persona, we will tell you why. You receive a written statement of the reason, except where giving it would itself be unlawful or would compromise an ongoing investigation.
You can challenge the decision. The Appeals Policy sets out what is appealable, how to file, and the possible outcomes. Where an appeal succeeds, your persona is restored.
You may close your account at any time. Earnings accrued before closure remain payable, subject to section 6.
12. Changes to this agreement
Where a change materially affects your rights or obligations, we will give at least 15 days' notice before it takes effect, and you may close your account during that period rather than accept it. Changes required by law, or needed to address a security or legal risk, may take effect sooner. Material changes are posted here with a new effective date.
13. Creators in the EU and the UK
If you are established or resident in the European Union or the United Kingdom, you are a business user under Regulation (EU) 2019/1150, and additional rights apply to you — including advance notice of changes, written reasons for any restriction, ranking transparency, and access to named mediators. Those rights are set out in the EU Platform-to-Business Terms, which form part of this agreement for creators in those markets.
14. A note on the law
The law governing AI replicas of real people is developing quickly and differs between jurisdictions. This agreement describes our process — how consent is captured, what is licensed, and how it is withdrawn. It does not assert a position on how any particular statute applies, and nothing here limits any right you have under the law where you live.
